Welcome to GemToon! These Terms of Service ("Agreement") constitute a binding legal contract between you ("User") and GemToon ("we," "us," or "our"). By accessing our mobile application, website, or any related digital products (the "Services"), you agree to be bound by this Agreement and our Privacy Policy.
If you are using GemToon on behalf of an organization, that entity accepts these terms and agrees to indemnify GemToon against any liability arising from its use of the Services.
Eligibility
By using GemToon, you represent that:
- You are at least 18 years old (or the age of majority in your region), or have obtained legal parental/guardian consent.
- You are at least 13 years old. GemToon is not intended for children under 13. If you are under 13, please do not use the Platform.
Scope of Services
GemToon provides a platform for viewing, subscribing to, and interacting with digital comics and related content.
- Third-Party Links: Our Services may contain links to external websites not owned by GemToon. We are not responsible for the content or privacy practices of these third parties.
- Service Modifications: We reserve the right to update, modify, or discontinue any part of our Services at our sole discretion without prior notice.
User Accounts
To access premium features, you must create a GemToon account.
- Account Security: You are responsible for maintaining the confidentiality of your password and for all activities under your account.
- Accuracy: You must provide truthful and complete information during registration.
- Unauthorized Use: Notify us immediately at anishamahrom@icloud.com if you suspect any security breach or unauthorized account access.
Usage Rules and Restrictions
GemToon grants you a limited, non-exclusive license to use the Services, provided you comply with the following:
- No Modifications: You may not alter or tamper with any part of the Platform or its code.
- No Automation: The use of "bots," "spiders," or any automated systems to scrape data or artificially inflate metrics (e.g., likes, views) is strictly prohibited.
- Lawful Use: You must comply with all local and international laws while using the Platform.
- No Data Harvesting: You are prohibited from collecting personally identifiable information of other users.
User-Generated Content
If the Platform allows you to submit content (comments, images, or stories):
- Responsibility: You are solely responsible for the content you post and the consequences of sharing it.
- Ownership: You represent that you own or have the necessary rights to any content you submit.
- Prohibitions: You may not post content that is illegal, infringing on intellectual property, or violates the rights of others.
- License to GemToon: By posting content, you grant GemToon a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content in connection with the Services.
Intellectual Property
All original content on GemToon, including logos, software, and proprietary graphics, is owned by or licensed to GemToon. You may not use our trademarks or copyrighted material without express written permission.
Payments and Refunds
- In-App Purchases: Transactions for virtual currency or subscriptions are processed via third-party app stores (Apple/Google).
- Refund Policy: Generally, all purchases are final and non-refundable, except as required by law or the policies of the respective app store.
Termination
We reserve the right to suspend or terminate your account and access to the Services at any time, with or without cause, especially for violations of this Agreement.
Disclaimers and Limitation of Liability
- "As Is" Basis: GemToon is provided without warranties of any kind, either express or implied.
- Liability Limit: To the maximum extent permitted by law, GemToon shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.
Governing Law
This Agreement shall be governed by the laws of the United States, without regard to its conflict of law principles.
